1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your access to and use of The Avia Effect, including the custom AI personality setup and The Avia Daily AI Partner Membership (together, the "Service"), provided by The Avia Effect LLC ("we," "us," "our"). By completing checkout or otherwise using the Service, you agree to be bound by these Terms.
2. Description of Service
The Avia Effect provides a guided intake questionnaire and uses your answers to generate a custom set of AI instructions, delivered by email, intended for use with third-party AI platforms such as ChatGPT. The Avia Daily AI Partner Membership provides ongoing educational content about communicating with AI. We do not develop, operate, or control the third-party AI platforms you choose to install your setup into.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to purchase or use the Service. The Service is intended for general personal and business productivity use, not for use by minors.
4. Purchase, Billing & ClickBank
Checkout is processed through ClickBank, the retailer of record for all purchases made on this site. Current pricing is $115 due at checkout, which includes your custom AI personality setup and your first month of The Avia Daily AI Partner Membership. After the first month, the membership renews automatically at $15/month until cancelled. ClickBank's own terms and payment processing policies apply to your transaction in addition to these Terms.
5. Cancellation
You may cancel The Avia Daily AI Partner Membership at any time through your ClickBank customer account at clkbank.com. Cancellation stops future billing but does not retroactively refund amounts already charged, except as described in our Refund Policy below.
6. Refund Policy
Refund requests are handled in accordance with ClickBank's standard Return and Subscription Cancellation Policy, which generally allows returns within 60 days of purchase, at ClickBank's discretion. To request a refund, visit clkbank.com and look up your order, or contact us directly at the email below.
7. License & Acceptable Use
We grant you a personal, non-transferable license to use the custom AI instructions delivered to you. You may not resell, redistribute, or publicly republish your custom setup or the underlying questionnaire content. You agree not to use the Service for any unlawful purpose or in a way that violates the terms of the third-party AI platform you install it into.
8. No Professional Advice
The Service does not provide legal, medical, financial, or mental health advice. Any output generated by your custom AI personality is for general informational and productivity purposes only. See our full Disclaimer for details.
9. Intellectual Property
All content on this site, including copy, design, and the structure of the intake questionnaire, is owned by The Avia Effect LLC or its licensors and may not be copied or reused without written permission.
10. Limitation of Liability
To the fullest extent permitted by law, The Avia Effect LLC is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including outcomes produced by AI platforms outside our control. The Service is provided "as is" without warranties of any kind, express or implied.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles.
